Read the following Terms and Conditions carefully. When you purchase or use my products, that implies that you have read and accepted the following Terms and Conditions.
AGREEMENT SUMMARY
You: You have the authority to enter into this contract on behalf of yourself. You’ll give the Artist assets and information we tell you we need to complete the project. You’ll do this when we ask and provide it in the formats we need. You’ll review our work, provide feedback and approval in a timely manner. You are responsible for approving and requesting changes. You also agree to adhere to the payment schedule, 50% upfront via PayPal, 50% upon completion.
Us: We have the experience and ability to do everything we’ve agreed with you and we’ll do it all in a professional and timely manner. We’ll endeavour to meet every deadline that’s set and on top of that we’ll maintain the confidentiality of everything you give us.
Artist will provide sketch before asking for remaining payment (tier dependant). At this stage you can correct Artist and give feedback (tier dependant). Depending on tier, X round of amends included. See process section for full tier process explanation. Additional amends will incur additional costs. Payment needs to be payed on PayPal provided by artist. After payment is received, painting process will begin.
Artist has all rights to cancel or refuse commission and refund whole payment.
If commissioner decide to cancel commission after painting process has begun, half of payment will be refunded. After artwork is done and shown to commissioner, no refunds are accepted.
DISPLAYING WORK
We reserve the right to display all aspects of our creative work, including livestreaming, recorded videos, sketches, work-in-progress designs and the completed project on our portfolio and in articles on websites, in magazine articles and in books.
CHANGES AND REVISIONS
All changes MUST be made when project is still in rough draft phase. Once final art is sent and work is done changes are not possible. Only changes that are possible even after artwork is finished are simple changes in colour. Due to realistic constraints, the artist has the right to take artistic freedom as long as it fits within the guidelines of the requested art.
REFERENCES
You must supply all references unless otherwise agreed on. If not the artist has the right to artistic freedom. Changes may be requested at the time of rough drafts.
LICENSE AGREEMENT
You are granted a nonexclusive limited license to use the art in accordance with these Terms and Conditions (the “license”) There are NO refunds and NO exchanges.
Non-EXCLUSIVE LICENSE AGREEMENT
The art is not for resale. Original purchasers may use the art for personal use ONLY.
MODIFICATIONS
The artwork may not be altered or modified without the written permission of the Artist.
COPYRIGHTS
You may use the art and reproduce it for your personal use only if you have purchased a license (agreed to the TOS). The art may not otherwise be reproduced, distributed to any other person, business, non-profit organization, or corporation or incorporated in any way into another document or material without prior written permission from the Artist. Any copy of the art must retain all copyright and other proprietary notices contained therein.
You do not have the right to mint an NFT of your commissioned piece.
OTHER MERCHANDISE
Arts are NOT to be used on other merchandise unless written permission from the artist has been granted and a royalty fee has been established. If the art is used the artist may request royalties to be paid to the max of 10% profit.TERMINATION
You may terminate this agreement at any time by destroying all copies of the art. Your license to use the art will terminate immediately if you breach this agreement.
LEGAL
We can’t guarantee that our work will be error-free and so we can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them. Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
